Coming from the days of the Youth Black Faith in the 1940's on 9th Street in Trench Town where the Nyahbinghi Ancient Council (NAC) established the Priesthood Order of the Theocracy Reign Order of the Nyahbinghi aka Nyahbinghi House, the first Tabernacle and the first Nyahbinghi Bass Drum in Jamaica, from that time to this time, we are making a moral and legal statement on the current state of affairs to ensure and enforce our human, social, and intellectual property rights against whoever infringes upon the Rastafari Community Rights.
It is to be noted that here in Jamaica, for the past decade or more, there has been unprecedented abuse of the NAC by a class of jr administrators that have been seeking to impose their individual and personal interest in and on the Ancients Collective Nyahbinghi Order (The Order).
As a result of Rastafari Sacramental Rights in the GANJA Bill, there’s been a rise in the abuse of due process by these junior (jr) administrators. This has been communicated clearly, verbally and in writing, on many occasions to the various parties of interest and Ministers allocated to protect and coordinate with the Nyahbinghi Priesthood Order our Rastafari Sacramental Rights. This situation has also given rise to further misappropriation by persons not associated or loosely associated with our Values, Faith, and principled Positions.
The Rastafari Rootzfest Cannabis Cup
The announced Press Conference by Rastafari In Inity at the Bob Marley Museum for Wednesday October 28th, 2015 after 2 poorly attended previous ones and are a continuing attempt to usurp the authority of the NAC. By intending to publicly announce the Rastafari Rootzfest Cannabis Cup Contract, instead of presenting the Contract to the NAC as requested for months now by representing attorney, A S V Law Firm and other mediators, amounts to a misrepresentation and malicious falsehood at best or a fraudulent act at worst, and so despite we have notified all concerned of the illegality of their actions. Recently summoned by the High Priest and other Members of the NAC to address the matter on Sunday, October 25th 2015 at the Morant Bay Rally, dismissed jr. administrator, Ras Iyah V aka Verald Vassel, has sought to divert Rastafari Community Intellectual Property (IP) benefits by not signing or causing to be signed the appropriate Rastafari IP Contract(s). Instead, passing off a paltry $1.00 give back from a $300USD ticket price to a Rastafari Trust Fund, while his organization 'Rastafari In Inity' attempts to administrate the Community IP Rights through an undisclosed contrived smokescreen of a 30% community give back at his personal discretion. Then he ('Rastafari In Inity') and High Times Ltd. will equally share (50/50) the proceeds from ticket sales, non-Sacramental Ganja sales, and other undisclosed income earnings while allowing High Times Ltd. and the GOJ to benefit Ja$Millions through various travel, hotel, and transportation package deals and schematics. In essence nothing (US$1.00) has been contractually or appropriately been set aside to address The Order or The Creed.
UNDUE APPROPRIATION OF OUR FAITH AND CULTURE
Since 2007, the NAC spearheaded the formation of the Ethio-Africa Diaspora Union Millennium Council (EADUMC) / Limited aka Rastafari Millennium Council (RMC), and both entities caused the gathering / formation of the Ancients Collective of the Nyahbinghi Order that includes the Leading / High Priests from Major Mansions, to address the Rights of the Rastafari Community Faith and Culture.
The most outright treachery against the Ancients Collective of the Nyahbinghi Order is the jr mal-administrators active collaboration with the Government of Jamaica (GOJ), specifically the Minister Of Justice, to misconstrue and attempt a coup on the NAC community governance rights. Ras Iyah V passing himself off as a self imposed Rastafari Leader through various media articles, collaborated and then hired a Harvard University Lawyer, Prof. Charles Nesson along with a conflicted local lawyer Marcus Goffe, an employee of Trademarks and GI at JIPO, to form a company called 'Rastafari In Inity'. All these were done whilst these same lawyers have worked directly with the Minister Of Justice in an attempt to delegitimize the RMC, dilute the Practice Note at JIPO governing Rastafari IP, and the Rastafari Intellectual Property Authority through the appropriate IP Contracts. The personal creation of a Rastafari Advisory Board specifically incorporating several prior and or dismissed Jr. Administrators by the Ministry of Justice, has taken all of the IP provisions of the RMC and presented it under this Advisory Board, which has no registered or otherwise authority to administrate. This while actively seeking to discredit the Executive Members/Directors of the RMC that have been reporting directly to the NAC and the Ethiopia Africa Black International Congress aka Bobo Shanti House. Clearly this is not right by any account. The Minister of Justice has been informed of these matters and to date no action seems to have been taken place by his Ministry or the Attorney General's office to stop or prevent further aggravation of The Order and Rastafari IP Rights.
The Nyahbinghi Coronation Ises for November 2nd, 2015 has not been approved for Pitfour Nyahbinghi Center based on the representatives of that Center not seeking the 60 year ongoing approval process of the Nyahbinghi Ancient Council and High Priest. This while all the Center representatives were summoned and attended at an event at the Morant Bay Court House and refused attendance. The Ceaseless Nyahbinghi at the Stony Gut Center in Morant Bay, that has been called and registered since September 11th, 2015, to defend the Nyahbinghi Ancient Order therefore stands.
Ras Iyah V has been perpetrating administrative irregularities against The Order principally around the Coral Gardens Committee and Events, Snoop Dogg, and now the Rastafari Rootzfest Cannabis Cup Event. In collusion with Sister Lorraine Mitzie Williams and Marcus Goffe, they have used their revoked NAC administrative position to infiltrate the EADUMC Ltd./ Rastafari Millennium Council calling an illegal meeting on April 6th 2014 without the recognized legal authority of the NAC, recounted in the By Laws of that organization, to attempt to reverse all the gains that the RMC has/was achieved in Intellectual Property (IP) Rights which is literally ALL the work and creative achievements of the Ancients Collective of the Nyahbinghi Order.
Splinter groups with no identified membership worthy of recognition has been bandied together by these Rogue Jr. administrators to give an illusion of Mansion representation when the major membership of the three largest Mansions, the Nyahbinghi House, Bobo Shanti House, and the Twelve Tribes of Israel, have not given them any mandate to overturn the RMC or operate in this current manner.
These Jr. Administrators have all been either dismissed or resigned administratively since 2012, a fact known to the Jamaican Government, and have used and or, we believe, manipulated the RMC passing off as Nyahbinghi House Representatives to defraud and interfere with the workings of that organization that has operated under the mandate of the NAC since 2007. The aggravated misappropriation against the NAC and the RMC by Calvin Broadus aka Snoop Dogg is a continuing fraud now challenging the management of JIPO where a hearing on the SNOOP LION Trademark Opposition matter has been stalled and involves Marcus Goffe as an employed manager of Trademarks. The RMC has written JIPO several times outlining Mr. Goffe breaching conflict of interests; JIPO has gone conspicuously silent on this matter.
The focus of the NAC is specifically on the Repatriation/Reparation Petition and the Governance of the Community's Intellectual Property Rights. This is the firm message to the Government of Jamaica and the CARICOM and the Global Community of Rastafari governed by the Priesthood Order of the Nyahbinghi.
These abuses have to stop here and now!
ELDER’S TRANSITION
The Rita Marley Foundation has, in collusion with these dismissed Jr. administrators, perpetrated an irregular land eviction/confiscation in this period against the Scotts Path Nyahbinghi Grounds and both are now, with the authority of that Foundation and no consultation with or approval by the NAC, preparing to bury Elder Bongo Shephan Fraser on the grounds come October 31st 2015 in direct disregard and disrespect and breech of the NAC, High Priest Bongo Vinn along with Other Priests, and the Guidelines. This when the family of Bongo Shephan was prepared and planning their transition responsibilities at Meadowrest. This is therefore an aggravated charge against these jr. administrators who have been condemned by the global Priesthood Order of the Nyahbinghi House.
The transition of our Elders where The Order and Guidelines of the NAC instructs that it is the responsibility of the immediate family with economic capabilities and in kind assistance from the Community, that must be in charge of the Rites of Passage; and to effect burial on Nyahbinghi Tabernacle Grounds is a continuing and unspeakable travesty.
Ras Ivi Tafari aka Donovan Wright a member of the Minister Of Justice contrived Advisory Board, has tried to incorporate and institute this fundamental change in The Order which has been unequivocally rejected by the NAC based on the specific spiritual charge of the Priesthood Order for Repatriation. He and others have breached the protocol of The Order by sending out an unapproved revised Guideline incorporating these and other matters. It is hereby stated that the Nyahbinghi Ancient Order Guideline from 1947 remains as is and any and all proposed modifications are suspended indefinitely. These rogue prior Jr. Administrators are charged morally and legally for interference in and around the Nyahbinghi Administration, and the NAC will be freed from their personal and governmental intrigues.
The proposed application for Sacramental Growing of Ganja and identification of Sacramental Spaces principally governed by the Priesthood Order of the NAC which was part designed by these clearly illegitimate jr. administrators on the Rastafari Advisory Board, has been done with NO consultation or approval of the NAC. No Spiritual or Church under the Constitution of Jamaica can have their spaces externally governed by Government in the separation of Church and State. And because the Government of Jamaica is under separate reparatory charges for the decades of destruction and loss of life related to these spaces and growing of Ganja for our Sacramental use.
THE NEXT STEPS
We have presented letters to the Office Of The Prime Minister, The Minister of Justice, The Attorney General of Jamaica, the Minister of Trade and Commerce and the Office of UK Prime Minister David Cameron on these Rights and will be presenting same to the United States (US) State Department who has presented advisories on the discrimination of Rastafari here in Jamaica and the Caribbean very recently. The approach by the National and CARICOM wide Reparation Commissions to take our multi-decade agitations against slavery and colonialism to relegate us to some 'portion' of their debt relief, national infrastructure, rehabilitation strategy, is not acceptable. We also made this very clear publicly and appointed our own representative to negotiate on our behalf and to date no-one has contacted them furthering the violation and abuse of our Rights and Name.
The Nyahbinghi Ancient Council is gazetting that former and dismissed Jr. Administrators, Verald Vassel aka Ras Iyah V, Lorraine Williams aka Sister Mitzie Williams, Mr. Donovan Wright aka Ras Ivi Tafari, and Marcus Goffe must not transact any business on behalf of the Nyahbinghi House, the EADUMC Ltd. aka Rastafari Millennium Council and / or any business representing any collective right or interest of the Rastafari Community.
The Rastafari Rootzfest and Rastafari In Inity Company are all companies that have been allowed to enter the commercial space by Marcus Goffe as an employee of JIPO and the Minister of Justice in possible collusion with Charles Nesson a client representative of High Times Ltd. All of these based on misrepresentation that has been clearly notified but ignored by all.
Absolutely no Intellectual Property of the Nyahbinghi Order, such and especially the Tabernacle or images of the Nyahbinghi Ancients is allowed to be shown or displayed at Long Bay Beach Negril.
No Rastafari Sacramental Spaces or Sacramental Growing of Ganja will be authorized without the prior informed consent of the recognized Priesthood Order of the Nyahbinghi Ancients.
The Rita Marley Foundation aka Bob Marley Foundation aka Bob Marley Museum are all entities that are in legal entanglement with the Scotts Path Headquarters of the NAC. Any co-branding of these parties with these illegal events will be considered to be actions to influence ongoing matters.
We appointed attorney Simon Vumbaca/ASV Law representing the Nyahbinghi Ancient Council and the EADUMC Ltd. aka RMC to deal with all the breaches on the part of these individuals. The Government of Jamaica, lack of due diligence in engaging these individuals and thus complicity and liability in the range of interference in the governance and contractual intellectual property rights of the Rastafari Community, faith and indigenous culture as established and engaged by various Government agencies.
Years of these abuses, unsuccessfully disciplined by the moral and customary authority of the NAC, has now been enjoined by a Ministry of Justice Rastafari Advisory Board making it now necessary for these matters be addressed in the Supreme Court of Jamaica and the International Court of Justice related to the abuses of our rights in relation to Repatriation with Reparation and our Intellectual Property Rights.
