161737_662625629_4927443_n.jpg?width=180What started with a Stone Mountain, Georgia couple - Wekesa and Afiya Madzimoyo - is now a 100+ member group encompassing the Atlanta Metro area. They are challenging GMAC, Bank of America, JPMorgan Chase, New York Bank of Mellon Trust and others.

In a state where robo-signing, fraudulent foreclosures and fake document processing centers go unchecked legislatively, homeowners have turned to the courts. Many of Justice@Home families have active cases in Georgia and Federal Courts. Many others are supporting seniors and college students – researching case law, editing documents, educating new-comers, never allowing any member to go to court alone.

 

According to Wekesa Madzimoyo, “lawyers are slow to represent those who have little money while facing opponents who have pockets as deep as the ocean.”  The natural place for citizens to turn would be the State Attorney General’s office. But in GA, the Attorney General claims that his office has been stripped of power to intervene in foreclosure matters at all. While Ohio’s top attorney, Cordray, can sue GMAC and “master robo-signer” Jeffrey Stephan for 25K per violation and restitution for the homeowners in Ohio, Georgia’s Attorney General fiddles while its homeowners and their neighborhoods burn in the flames of fraudulent foreclosures. Too often, master robo-signer Jeffrey Stephan strikes the match.

 

“That’s who signed the fake assignment in my real estate record,” says Afiya Madzimoyo, referring to Jeffrey Stephan. While most Justice@Home fighters are at the GA State level, Mr. and Ms. Madzimoyo are headed to the United States Court of Appeals for the Eleventh Circuit – Northern District.

It’s shaping up to be a classic David and Goliath story, but all the cases don’t have the Biblical ending. Mr. Madzimoyo says, “We’re winning battles at a rate of about 40% right now, and we’re not about to stop.

 

The group’s main goals are fighting, educating, and healing. “Most people don’t really know why banks don’t want modifications to succeed; they don’t know how the incentive structure has changed so that banks make more money when you default. Legislators and judges don’t even see how this leads to abuse of Georgia’s Power of Sale clause, so we educate them,” says Damani Aaquil, one of the group’s supporters.

 

Mr. Madzimoyo says, “We must also heal our community. Many people suffer in silence blaming themselves for all of this. That blame induced by calling this the “subprime” mortgage crisis, caused by “deadbeat” homeowners, stops people from seeking the redress they are due, and getting the support they need and deserve.”

“While we know that many in the country are hurting, few realize the hit to Black wealth this represents. Our schools and churches are closing. It’s like some demonic suction tube, and we have to stop it,” says Ms. Madzimoyo.

 

While there are many pro se litigants around the nation who are using the internet to bring court action, Justice@Home represents the first time that we know of neighbors in a metro area coming together to exhort and support each other in this foreclosure fight. They’ve been meeting every Tuesday night for nearly two years now. 

Referring to both his case and the movement, Wekesa Madzimoyo quickly adds, “Our cause is just, and we will fight until we win, until we get Justice@Home.”
