News conference announcing an important appeal filed in legal challenge to Michigan's emergency manager law (PA 436). The plaintiffs' brief urges U.S. Court of Appeals for the Sixth Circuit to reinstate claims that PA 436 discriminates on the basis of income and race, depriving thousands of Michigan citizens of fundamental right to vote. Under this law, emergency managers were directly responsible for switching the source of Flint's water supply and the ensuing lead-tainted water crisis. The appeal is in the case ofPhillips et al. vs. Snyder, a federal lawsuit filed in 2013.

Why:
Civil rights attorneys and community activists involved with legal effort to overturn PA 436, will explain their appeal filed late last week in U.S District Court. The brief challenges the constitutionality of a law that deprives residents of financially-strapped cities and towns of the right to elect the officials who govern them. The original lawsuit alleges EM law has been applied in a racially-discriminatory manner; that it targeted African-American communities for emergency management; and that it violated the Equal Protection Clause of the 14th Amendment of the Constitution and the Voting Rights Act of 1965.
