It has just been renewed for its sixth season beginning April 2016. It chronicles a fictionalized version of the Western European Middle Ages’ struggles between families jockeying for power, prestige, and ultimately, the monarchy.

Its stock-in-trade are war, conflict, violence, and sex as played out in this ultimate power game. Now, the people of the US have their own real life Game of Thrones that begins with the announcement of the death Antonin Scalia.

“Liberals” on the Court now can only look back longingly on the days in which they ruled. Those were the days when Earl Warren, appointed by Republican President Eisenhower, ended legal US apartheid in landmark civil rights decisions like Brown v. Board of Education and Loving v. Virginia. The Warren Court protected civil liberties enshrined in the Bill of Rights and strengthened secularism and federalism.

But, during subsequent years, Republican Presidents eroded the liberal leanings of the Supreme Court by appointing arch conservatives.

Current Court Chief Justice John Roberts was nominated by President George W. Bush, as was Justice Samuel Alito; Justices Anthony Kennedy and Antonin Scalia were appointed by President Reagan; Clarence Thomas was appointed by President George Herbert Walker Bush. The “liberal” wing of the Court is solidly represented by the appointments of President Clinton (Ruth Bader Ginsburg and Stephen Breyer) and President Obama (Sonia Sotomayor and Elena Kagan). Scalia and Thomas could always be counted on to assume the arch conservative positions; Justices Alito and Roberts generally clung to the conservative pole and Kennedy was viewed by some as a sometimes “swing” vote for the liberals. All of that falls by the wayside now as the US Supreme Court is split four - four. The future of the US Supreme Court, conservative or liberal, now hangs in the balance. Thus begins this story-line in the real life Game of Thrones.

Conspiracy theorists suspect poison, Obama, and Leonard Nimoy in death of Antonin Scalia

The two most important questions under discussion now involve when the nomination for Scalia’s replacement will be made and by whom. The US is currently deeply in the throes of a Presidential election; naturally, Democrats want President Obama to announce his selection now, but the Republican Senate has vowed to block whoever might get the nod from Obama. Some Democrats have suggested candidates that would make it very difficult for Republicans to turn down, like, for instance, a sitting Republican governor. All eyes are on President Obama as this game has only just begun. The tie-breaking next Supreme Court Justice might just have to wait until a new President is sworn in to get the call. This constitutes sub-plot number one in our Game of Thrones. It is this sub-plot that has consumed much attention in the press as Presidential candidates discuss the tremendous loss to the country of Justice Scalia and weigh in on whether or not President Obama should wade into the Scalia-replacement waters.

Sub-plot number two involves how the Supreme Court nomination can augment lagging Presidential prospects for the Democratic and Republican candidates. For example, one author, Rob Hager, has suggested that Bernie Sanders could shore up his lagging “people of color” credentials by preparing a short-list of possible nominees of black women – including me! This same author also suggests that Senator Sanders could also announce a process for all of his judicial appointments so that especially voters of color, could have confidence that their interests will be given adequate attention by President Sanders in the area of administration of justice.

Now, while all of this overt politicking is going on at the media level, another sub-plot, number two, is developing around just exactly how the suggested nominee should look and think. There is a strong push, for example, for the naming of a black woman to the Bench to offset the cynical appointment of Justice Clarence Thomas who uses every opportunity to votes against bolstering civil rights every chance he gets. In fact, I personally had a case go to the Supreme Court and on the day that the Spotted Owl was protected by the nation’s highest Court, Black voters, victimized by dwindling popular support for enforcement of the Voting Rights Act, saw their voting rights scattered to the four winds, with Clarence Thomas voting against enforcement of that historic achievement of Dr. Martin Luther King, Jr.

The Supreme Court also has unfinished business whose outcome is certainly now more uncertain. Some companies have already adjusted to the new reality, like Dow, settling disputes out of Court because a sure vote in their favor is now gone. Sub-plot number three involves the 69 or so cases, according to the American Bar Association, scheduled for the 2015-2016 term, now affected by the vacancy caused by Scalia’s death. The five cases to watch selected by the Constitution Center involve voting rights, labor unions, affirmative action, abortion, and Obamacare.

The statements, views and opinions expressed in this column are solely those of the author and do not necessarily represent those of RT.

--

----------------------------------------------------------+
| __o CONTINENTAL CRITICAL MASS
| _`\;,_ come ride with me
| (*)/ (*)
| Bike4Peace Across the USA
-----------------------------------------------------------+

http://claritypress.com/McKinneyII.html
http://www.claritypress.com/McKinney.html
https://www.facebook.com/CynthiaMcKinneyOfficial
http://www.allthingscynthiamckinney.com/CynthiaSpeaks

Silence is the deadliest weapon of mass destruction.
Supreme Court Justice Antonin Scalia’s suggestion during a hearing of oral arguments for the case of Fisher v. University of Texas at Austin that African-American students do not benefit from attending more academically rigorous colleges is at odds with empirical research on the subject, according to researchers at the Georgetown University Center on Education and the Workforce (Georgetown Center).

In prior research, Georgetown Center economists have found that students at more selective colleges, including black and Hispanic students, have higher graduation rates regardless of their level of academic preparation.

“Justice Scalia is making the tired argument that admitting African-American students into white schools is akin to putting ponies in a horse race,” said Nicole Smith, the Georgetown Center’s chief economist. “Like so many, Justice Scalia mistakes African American as a proxy for low readiness, when in fact minority students in more selective colleges and universities not only graduate at relatively higher rates, but also secure high-paying jobs thereafter.”

“If Scalia’s theory were true, equally prepared students of all races would do worse at more selective colleges,” said Anthony P. Carnevale, the Georgetown Center’s director. “In fact, we find the opposite is true.”

With Orwellian reasoning, 5 out of 9 justices stated that the freedom of religion of these companies and bosses is more compelling than women’s healthcare and right to decide when, or if, to have children. This depravity towards women is a reflection of the on-going rightward turn in U.S. politics.

This decision follows on the heels of one that tossed out the 35-foot buffer zone around Massachusetts abortion clinics, which was enacted to stop the harassment of patients. Within days, the holier-than-thou fetus fanatics have stepped up their harassment of clients entering clinics.

Added to these affronts is a decision that weakens public sector unions, one of the most militant arms of organized labor. The ruling says that thousands of home health-care workers – most often women, people of color and immigrants – are not the kind of state employees who can be required to pay fees to cover a union’s cost of collective bargaining, despite being covered by negotiated conditions.

Yes, the U.S. Supreme Court ended this session with sledgehammer rulings against working women and men.

Radical Women is appalled, but not surprised, by this trifecta of defeats. In the absence of a militant women’s movement, the right-wing has framed the debate, and they have done so effectively. Today corporations appear to have more civil rights than actual living and breathing residents.

To keep what passes for “peace” under capitalism, the corporations and their media pundits have been working overtime to quell working people’s resistance and divide natural allies – racism, homophobia, sexism and ableism are just a few of the arrows in capitalism’s quiver. To create a safe, sane, just world for humans and every other living being, will take a movement that gets beyond just addressing one or two issues and goes far beyond voting for this corporate-backed party or that one.

Let’s be honest: attempts to make Democratic Party politicians “grow a backbone” against the onslaught of attacks aimed at women’s reproductive choices and working people’s rights have been a failure. And concentrating all progressive efforts on electing Democrats has essentially let Republican politicians off the hook.

The twin parties of the capitalist system aren’t going to change. Working women and men deserve a voice – at the polls and also in the streets. The feminist movement needs to move to the left and embrace a multi-issue, anti-capitalist agenda. The ultra-conservatives coordinate their attacks; feminists need to reach out with as broad a program in response.

Outrage and anger will get people out in the streets – Slut Walks and Occupy showed that. But protests founded on strong program and politics win the day. The first step is to openly debate the issues like the feminist movement did in the 1960s and 70s. Questions like the origins of sexism and racism, and how to balance needed reforms and long term solutions were discussed and examined. This analysis is crucial for any political movement to learn, develop and grow.

Radical Women and many other activists continue to strive to build these connections and address the issues of those who suffer most – single moms, immigrants, young women of color, trans folks – the same people regularly vilified by today’s politicians and conservative talking heads.

Take the leadership of those who have the most to gain, add the multi-issue demands of the most oppressed, round it out with an anti-capitalist program, and you have a recipe for creating the economic and social revolution needed so desperately today. As these recent Supreme Court rulings underscore, it’s time to knock out the right with a feminist lef
